Subject: [QUESTION] Push a driver upstream

Hi list,

I bought a USB ethernet device and found the Linux driver on CD.
I asked the author if he'd like to push the driver upstream, but no response.

So I wonder if it's legal for me to push the driver upstream.
Do I need the author's agreement?

Below is the driver header.

/*

 * kind, whether express or implied.
 */

Thanks,
Lin Ming
