the difference between working and non working seems to be in:

ACPI: BIOS _OSI(Linux) query honored via DMI

and 

ACPI: BIOS _OSI(Linux) query honored via cmdline


via DMI seems to be working as expected, via cmdline does not work. Any ideas?
