Good catch.  I've changed it to:

if (dev->hs_config)
	gadgetfs_driver.max_speed = USB_SPEED_HIGH;
else
	gadgetfs_driver.max_speed = USB_SPEED_FULL;

just before usb_gadget_probe_driver(), which should do the trick.
