Due to this being a fall-through-if here - the first if condition has no effect either - so it also can be removed. struct mlme_priv is thus also no longer needed here. This needs a check by someone who knows the details of the driver as it could be that the two branches actually should be different. >From the comments it seems that an effect is actually intended so this may be a bug.
