Would doing

-	chip->ds = dsa_switch_alloc(chip->dev, DSA_MAX_PORTS);
+	chip->ds = dsa_switch_alloc(chip->dev, LAN9303_NUM_PORTS);

at the same time be good, or breaking the scope of the patch?
