shouldn't it be:

if (!ctrl->subsys || ((ctrl->subsys->cmic & (1 << 3)) == 0))

or

if (!ctrl->subsys || !(ctrl->subsys->cmic & (1 << 3)))


Otherwise, you don't really do any initialization and return 0 in case you have the capability, right ?
