Could you please explain relationship between IC types and "pattern"?
Can there be controllers with same IC type but different patterns?
Do SMbus controllers use the new report type? Do controllers use only
one type of report (old or the new 0x60), or can they send mix?

There is no point in executing this max for 16 bit value, so if we can
drop this altogether, as long as we are certain that older firmware did
not return garbage in 4 upper bits of this data.

I think it is OK if you declare buffer as:
u8 buffer[max(ETP_I2C_REPORT_LEN, ETP_I2C_REPORT_LEN_ID2)];
and do not worry about dynamic allocation. It should be OK if you do a
partial read here, we just want to make sure we consume all pending data
before re-enabling interrupts.
