I see your point. I will remove that
!IS_ENABLED(CONFIG_BINFMT_FLAT_NO_TEXT_DATA_GAP) from the top if() condition.
Without it, fixing the toolchain etc will indeed not require patching again the
kernel. Sending a v4.
