Ah, didn't realize BUG_ON is discouraged. Removed BUG_ON. 
It was supposed to be a defensive bit of code anyway, 
so removing the check entirely. If the state is 
inconsistent, we'd see other errors, so the BUG_ON 
wasn't providing value anyway.
