Mhh actually this looks intentional:

icmpv6_send and some other output functions do:
	int hlimit;
...
        if (hlimit < 0)
                hlimit = dst_metric(dst, RTAX_HOPLIMIT);
        if (hlimit < 0)
                hlimit = ipv6_get_hoplimit(dst->dev);
