mdio_bus_phy_suspend()
  phy_stop_machine()
    phydev->state = PHY_UP  #  if (phydev->state >= PHY_UP)

So apparently PHY_UP is a legal state for a suspended PHY.

Hm, maybe the WARN() should be dropped altogether?
